In this article, published in "Perspective" (a newsletter of the Young Lawyers Section of the New York State Bar Association), Warshaw Burstein summer 2021 interns Laura Cohen, Christopher Haughey, and Matthew Zapata explore the U.S. Supreme Court’s 2021 decision Mahanoy Area School District v. B.L. by and through Levy and provide guidance on American public schools’ ability to regulate students’ off-campus speech moving forward. The ruling is the first time the Supreme Court has weighed in on student free speech since 1969, when the court ruled that a school in Iowa could not prohibit students from wearing black armbands to protest the Vietnam War.
