Mr. Marcucci maintains a broad litigation practice that encompasses nearly every type of commercial dispute.

He counsels corporate and individual clients in federal and state courts in complex matters involving the federal securities laws, breach of contract, fraud, breach of fiduciary duty and other business torts, and many other areas. He has advised and represented clients at every stage of litigation, from pre-litigation negotiations through commencement, motion practice, trial, appeals, and settlement.
 
Mr. Marcucci’s representative matters include the following:
  • Represented hedge fund in federal securities action involving claims of market manipulation.
  • Represented internationally renowned scientist and inventor in complex litigation involving ownership and control of multinational biomedical company.
  • Represented member of real-estate partnership group in multiple litigations involving group’s valuable portfolio of Manhattan properties, including prosecuting and defending against claims alleging breach of partnership agreements, breach of fiduciary duty, and other business torts.
  • Represented holder of mortgage debt encumbering residential multi-family real property in action against property’s fee owner to enforce contractual purchase option.
  • Represented one of New York’s Native American Indian nations in dispute over nation’s right to its reservation land, including in successful appeal affirming nation’s sovereignty.
  • Represented one of the world’s largest costume designers, manufacturers, and distributors in award-winning restructuring matter, including adversarial proceedings within the company’s Chapter 11 case.
  • Represented high-net-worth art collectors and investors in multiple lawsuits arising from substantial art fraud.
  • Represented online advertising company in successful federal jury trial of Lanham Act and defamation claims.
  • Represented noteholder in mortgage foreclosure action involving Manhattan commercial real property.
