Kimberly C. Lau and Title IX and College Discipline Practice Team Prevail Against Rutgers University
10/11/2024Warshaw Burstein, LLP announced that Kimberly C. Lau, partner and chair of the firm’s Title IX and College Discipline Practice, and her team including James E. Figliozzi, counsel, and Branden Lynn, associate, succeeded in U.S. District Court against Rutgers, the State University of New Jersey, on its Motion to Dismiss their client's Title IX claim.
The client's allegations sufficiently showed gender bias when his Title IX report was not investigated, and Rutgers erroneously suspended him after ignoring common sense exculpatory evidence in the hearing.
“We are pleased with Judge Quraishi’s decision, and for our client,” Ms. Lau said. “Now Rutgers must file an answer to the complaint, and the case will move forward into discovery.”
