Chronicle of Higher Education Interviews Kimberly C. Lau on Yale Defamation Case

Lau, partner and chair of the firm's Title IX and College Discipline Group, who herself won a defamation lawsuit for a client at Clemson University, was recently interviewed for the article, "Talking About Campus Sexual Assault Could Get You in Trouble. A Long-Running Legal Fight Shows How," in The Chronicle of Higher Education.
The article analyzes a lawsuit involving a former Yale University student who gained national attention after suing a classmate who accused him of sexual assault for defamation, and is now suing the organizations that backed his accuser.

"Kimberly Lau, a partner and chair of the Title IX and College Discipline Practice at Warshaw Burstein law firm, has experience representing both students who report sexual assault and students who face accusations. She said Khan’s choice to sue, instead of requesting to seal the document, could be an attempt to prevent future defamatory statements being made about him and others in similar circumstances.
“'Some words have very impactful meanings and can be life-altering once you say them,' she said. 'It’s amazing how when you put the word ‘alleged’ in front of ‘rapist,’ it changes dramatically the level of liability somebody has.'”
